Before taking further action

When can you take the next step?

A demand letter gives the company an opportunity to settle before you escalate. Some company terms require an informal dispute process before arbitration or court. The waiting period depends on the company, your account and the route you take.

Microsoft
60 daysBefore arbitration under its U.S. Services Agreement

Allow 60 days after Microsoft receives a completed Notice of Dispute for informal resolution. Its small-claims option is separate: section 15.c allows an eligible individual claim instead of sending that notice. The 60 days is not a blanket small-claims waiting rule.

Roblox
60 daysInformal resolution before arbitration or small claims

Its mandatory informal dispute process takes place within 60 days of receiving written notice, unless both parties agree to extend it. Participate in the process, including a conference if requested. Its small-claims option requires this process first; limited exceptions apply.

TikTok
60 daysInformal resolution before legal action, with an earlier-response rule

Its U.S. terms give the recipient 60 days to respond. If unresolved, legal action may follow when that period ends or 30 days after a response is issued, whichever is earlier. Both sides must make a good-faith effort to resolve the dispute first.

Meta, Google, X and LinkedIn
30-day reply requestOur letter default, not a verified minimum before filing

No fixed pre-filing waiting period was identified in the general Google, X or LinkedIn terms reviewed. Additional product terms may differ. Meta requires a separate check of the applicable Facebook, Instagram or commercial terms. Do not treat this 30-day request as permission to file.

Small claims has its own rules

There is no single 30- or 60-day waiting rule for all small-claims cases. For example, California Courts says that after asking for payment, you can wait for a reply or file right away. A separate contractual notice process may still apply to your dispute. Check both before filing, especially if a filing deadline is close.

California Courts: asking for payment before small claims

These examples concern U.S. account disputes. Where the terms require notice, the process starts when a compliant notice is received, not when you order or pay. Mailing a letter alone may not complete required forms or discussions. Check the applicable terms, court requirements and filing deadlines before taking further action. A U.S. correspondence address does not change your country of residence.

Review, delivery and formal notice requirements

You can edit and preview the letter before it is sent. If you request Hacked.com review, mailing waits until that review is complete and the final version is approved. No fixed review turnaround is promised.

Printing and delivery happen after final approval. Timing varies by destination and postal service. Follow available updates in your demand-letter dashboard; an estimated delivery date is not confirmation that the company received it.

Review the reply, proof of receipt, applicable notice process and court requirements before escalating. A reply request is not a court filing deadline, and elapsed time alone does not complete every company's process. Check filing deadlines separately; do not assume a demand letter extends them.

Microsoft requires a completed Notice of Dispute form for its U.S. pre-arbitration process. Our letter preparation does not automatically replace that form. Its separate small-claims option has different requirements. Microsoft’s guidance.

If your issue stays unresolved

A first step before considering court

Explore Small Claims Case Preparation

A demand letter gives the company a written opportunity to resolve your complaint before you consider further action. It records what happened, what you are requesting, and your attempt to settle the dispute.

If the issue remains unresolved, the letter and available mailing records may support preparation for a small claims case. Sending this letter does not file a lawsuit or establish that your claim qualifies. Requirements depend on the court, your circumstances, and the company's applicable terms.

California’s small claims guidance includes asking the other side for payment before filing. Read the court guidance.
